Terms and Conditions

1. Acceptance of these Terms

These Terms and Conditions ("Terms") form an agreement between you and ImanPintar ("ImanPintar", "we", "us" or "our"). They apply to the ImanPintar website, web app, progressive web app and official desktop or mobile applications (collectively, the "Service"). By accessing or using the Service, you agree to these Terms and our Privacy Policy. If you use the Service for a mosque, surau or other organisation, you confirm that you are authorised to accept these Terms on its behalf.

If you do not agree to these Terms, do not access or use the Service.

2. The Service

ImanPintar provides tools for configuring and displaying prayer times, adhan and iqamah schedules, mosque or surau information, announcements, images, documents, live camera output, media and related content. Features may vary by device, operating system, subscription, location or application version and may require an active internet connection.

3. Accounts and authorised access

You must provide accurate information, protect your login credentials and restrict administrative access to authorised persons. You are responsible for activity performed through your account and paired display devices. You must notify us promptly at support@imanpintar.my if you suspect unauthorised access or a security incident.

You may not share access in a way that circumvents applicable user, organisation or subscription limits. We may require verification that you are authorised to manage an organisation or its content.

4. Prayer times and religious information

You are responsible for checking the selected prayer zone and verifying information against the relevant religious authority, including JAKIM or the applicable state Islamic authority in Malaysia. The Service is an operational display tool and does not replace an official religious ruling, announcement or instruction. Authorised administrators should confirm schedules before relying on automated audio, announcements or public displays.

5. Your content and responsibilities

You retain your rights in content you submit, upload, link or configure through the Service ("Your Content"). You grant us a limited, non-exclusive licence to host, copy, process, display and transmit Your Content only as necessary to operate, secure and support the Service.

You confirm that Your Content and your use of it:

• are accurate where accuracy is reasonably required;
• do not infringe copyright, trademark, privacy, publicity or other rights;
• do not contain malware, unlawful material, deceptive information or harmful code;
• do not expose personal information without appropriate authority or consent; and
• comply with applicable laws and the requirements of your mosque, surau or organisation.

You are responsible for reviewing public announcements, uploaded media and external links before they are shown on a public display.

6. Camera, microphone and device permissions

Features such as live camera display, audio, automatic location detection, file selection or notifications may require device permissions. You decide whether to grant these permissions and may withdraw them through your browser or operating-system settings. Certain features will not work when required permission is denied. You must obtain any consent required from individuals who may appear in camera output or whose information is displayed through the Service.

7. Third-party services and content

The Service may link to or display content from YouTube, Vimeo, Google Drive, streaming providers, official prayer-time sources or other third parties. We do not control these services and are not responsible for their availability, content, security or practices. Your use of a third-party service may be governed by its own terms and privacy policy. You are responsible for obtaining any licence or permission required to stream, play or publicly display third-party media.

8. Licence to use the applications

Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable licence to install and use the official ImanPintar applications for their intended purpose. The applications are licensed, not sold. Except where applicable law permits otherwise, you may not:

• copy, resell, sublicense, rent or commercially redistribute the applications;
• reverse engineer, decompile or attempt to extract source code;
• remove intellectual-property, security or attribution notices;
• circumvent security, access controls, account limits or technical restrictions; or
• use an unofficial or modified application in a manner that harms the Service or others.

9. Acceptable use

You must not use the Service to break the law, interfere with networks or devices, gain unauthorised access, impersonate others, distribute malicious code, overload the Service, scrape data without permission, test vulnerabilities without written authorisation or harm another person or organisation. You must not use the Service to publish hateful, threatening, defamatory, obscene or otherwise unlawful content.

10. Intellectual property

The Service, including its software, design, branding, documentation and original content, is owned by or licensed to ImanPintar and is protected by applicable intellectual-property laws. These Terms do not transfer ownership of our intellectual property or that of any third party. "ImanPintar" and associated branding may not be used in a way that suggests endorsement without prior permission.

11. Updates, availability and changes

We may provide updates, security fixes or feature changes and may modify or discontinue part of the Service. Some updates may be installed automatically through an app store, operating system or the web application. We aim to maintain a reliable Service but do not guarantee uninterrupted, error-free or permanently available operation. Maintenance, network failures, third-party outages and events outside our reasonable control may affect availability.

12. Suspension and termination

You may stop using the Service at any time. You may request account or data deletion as described in our Privacy Policy. We may restrict, suspend or terminate access if we reasonably believe there is a violation of these Terms, a security risk, unlawful activity, non-payment of applicable charges or a need to protect the Service, users or third parties. Where reasonable, we will provide notice or an opportunity to resolve the issue.

Provisions that by their nature should continue after termination—including intellectual-property, disclaimer, liability and dispute provisions—will survive termination.

13. Disclaimer of warranties

To the maximum extent permitted by law, the Service is provided on an "as is" and "as available" basis. We disclaim implied warranties of merchantability, satisfactory quality, fitness for a particular purpose, non-infringement and uninterrupted or error-free operation. We do not warrant that prayer information, third-party content or user-configured information will always be complete, current or accurate.

Nothing in these Terms excludes warranties or consumer rights that cannot lawfully be excluded.

14. Limitation of liability

To the maximum extent permitted by law, ImanPintar and its personnel will not be liable for indirect, incidental, special, consequential, exemplary or punitive loss, or for loss of profits, revenue, goodwill, data or business opportunity arising from or related to the Service. We are not responsible for losses caused by incorrect configuration, unauthorised account use, third-party services, internet failure or reliance on unverified prayer times or announcements.

Where liability cannot be excluded, it will be limited to the extent permitted by applicable law. Nothing in these Terms limits liability that cannot legally be limited, including liability for fraud or wilful misconduct.

15. Indemnity

To the extent permitted by law, if you use the Service on behalf of an organisation, that organisation agrees to indemnify ImanPintar against third-party claims, losses and reasonable costs arising from Your Content, your unlawful use of the Service or your material breach of these Terms. This provision does not apply to the extent a claim was caused by our own breach or misconduct.

16. App store terms

If you obtain an application through Microsoft Store, Google Play, Apple App Store or another distributor, that distributor's terms also apply. Where those terms conflict with these Terms regarding your relationship with the distributor, the distributor's terms will govern to the extent of the conflict. The distributor is not responsible for support or claims relating to the Service except where its terms or applicable law expressly provide otherwise.

17. Governing law and disputes

These Terms are governed by the laws of Malaysia, without regard to conflict-of-law principles. Subject to any mandatory consumer rights or jurisdiction required by applicable law, disputes relating to these Terms or the Service will be subject to the courts of Malaysia. Before starting formal proceedings, you agree to contact us and attempt to resolve the dispute in good faith.

18. General terms

If any provision is found unenforceable, the remaining provisions will continue in effect. Our failure to enforce a provision is not a waiver. You may not assign your rights or obligations under these Terms without our consent; we may assign them as part of a restructuring, merger, acquisition or transfer of the Service. These Terms and the Privacy Policy constitute the agreement between you and us concerning the Service, except for any separate written service agreement.

19. Changes to these Terms

We may update these Terms to reflect changes to the Service, law or our practices. We will publish the updated Terms on this page and revise the effective date. If a change is material, we may provide additional notice where appropriate. Continued use after the revised Terms take effect means you accept them, subject to applicable law.
